VIOLATIONS, FORMS, LEVELS OF PENALTIES, LEVELS OF POINT DEDUCTION FROM DRIVING LICENSES AND REMEDIAL MEASURES FOR CONSEQUENCES OF ADMINISTRATIVE VIOLATIONS OF TRAFFIC ORDER AND SAFETY IN THE FIELD OF ROAD TRAFFIC

Section 1. VIOLATION OF ROAD TRAFFIC RULES

Article 6. Penalties and deduction of driving license points for drivers of automobiles, four-wheeled motorized passenger vehicles, four-wheeled motorized cargo vehicles and vehicles similar to automobiles violating road traffic rules

1. A fine of 400,000 VND to 600,000 VND shall be imposed on a driver who commits one of the following violations:

a) Failure to comply with the commands and instructions of traffic signs and road markings, except for the violations specified in Point a, Point c, Point d, Point dd, Point e, Point n, Point o, Clause 3; Point a, Point b, Point dd, Point e, Point i, Point k, Point l, Clause 4; Point a, Point b, Point c, Point d, Point dd, Point i, Point k, Clause 5; Point a, Clause 6; Clause 7; Point b, Point d, Clause 9; Point a, Clause 10; Point dd, Clause 11 of this Article;

b) When entering or exiting a stopping or parking position without signaling to notify other vehicle drivers;

c) Failure to signal with emergency lights or failure to place a warning sign “Attention to parked vehicles” as prescribed in case of technical problems (or other force majeure) forcing the vehicle to park in a part of the roadway or in a place where parking is not allowed, except for the violation specified in Point c, Clause 7 of this Article;

d) Not attaching warning signs in front of the towing vehicle or behind the towed vehicle; operating a trailer without warning signs as prescribed;

d) Using the horn from 10:00 p.m. the previous day to 5:00 a.m. the following day in densely populated areas, medical examination and treatment facilities, except for priority vehicles on duty as prescribed.

2. A fine of 600,000 VND to 800,000 VND shall be imposed on a driver who commits one of the following violations:

a) Changing lanes in an unauthorized place or without signaling or changing lanes in violation of the regulation that “each lane change is only allowed to be made to one adjacent lane”, except for violations specified in Point g, Clause 5 of this Article;

b) Carrying more people in the cockpit than the prescribed number;

c) Failure to comply with regulations on giving way at road intersections, except for violations specified in Point n and Point o, Clause 5 of this Article;

d) Stopping or parking on the roadway in a section of road outside urban areas where the sidewalk is wide; stopping or parking not close to the right edge of the road in the direction of travel in a road with a narrow sidewalk or no sidewalk; stopping or parking against the direction of traffic of the lane; stopping or parking on a fixed median strip between two sections of the roadway; parking on a slope without chocking the wheels;

d) Stopping the vehicle not close to the curb or sidewalk on the right side of the road in the direction of travel or the nearest wheel is more than 0.25 meters from the curb or sidewalk; stopping the vehicle on a road reserved for buses; stopping the vehicle on a drainage manhole, the opening of a telephone or high-voltage power line, or a place reserved for fire trucks to get water; leaving the driving position or turning off the engine when stopping the vehicle (except for leaving the driving position to close or open the vehicle door, load or unload goods, or inspect the vehicle’s technical condition) or leaving the driving position when stopping the vehicle but not using the parking brake (or taking other safety measures); stopping or parking the vehicle in an incorrect location in sections where there is a designated place to stop or park the vehicle; stopping or parking the vehicle on the road section reserved for pedestrians to cross the road; stopping the vehicle where there is a “No stopping or parking” sign, except for violations specified in Point d, Clause 4, Point c, Clause 7 of this Article.

3. A fine of VND 800,000 to VND 1,000,000 shall be imposed on a driver who commits one of the following violations:

a) Driving a vehicle at a speed exceeding the prescribed speed from 05 km/h to under 10 km/h;

b) Using the horn, revving the engine continuously; using the air horn, using high beams when encountering pedestrians crossing the road or when driving on a road through a residential area with an active lighting system or when encountering oncoming vehicles (except in cases where the median strip has anti-glare capability) or when changing direction at an intersection, except for priority vehicles on duty as prescribed;

c) Changing direction without observing or ensuring a safe distance from the vehicle behind or without reducing speed or without signaling a turn or signaling a turn but not using it continuously during the change of direction (except when driving along a curved road section where the road does not intersect at the same level);

d) Failure to comply with regulations on stopping and parking at road intersections at the same level as railways; stopping and parking within the protection area of ​​railway works or the safety area of ​​railways;

d) Stopping or parking at the following locations: at road intersections or within 05 meters from the edge of the intersection; at pick-up and drop-off points; in front of or within 05 meters on both sides of the gate of an agency or organization’s headquarters with a road for vehicles to enter and exit; where the road section is only wide enough for one lane of motor vehicles; obscuring road signs and traffic lights; at a median strip; within 20 meters of a car parked in the opposite direction on a narrow street, or within 40 meters on a road with one lane of motor vehicles in one direction;

e) Parking a vehicle not close to the curb or sidewalk on the right side of the road in the direction of travel or the nearest wheel is more than 0.25 meters from the curb or sidewalk; parking on a road reserved for buses; parking on a drainage manhole, the opening of a telephone or high-voltage power line, or a space reserved for fire trucks to get water; parking or leaving a vehicle on the sidewalk in violation of the law; parking where there is a “No Parking” sign or a “No Stopping and Parking” sign, except for violations specified in Point d, Clause 4, Point c, Clause 7 of this Article;

g) Not using or not using enough lighting from 6:00 p.m. the previous day to 6:00 a.m. the following day or when there is fog, smoke, dust, rain, or bad weather that limits visibility;

h) Driving a car towing another vehicle or object (except in the case of towing a trailer, semi-trailer or another specialized car or motorbike when this vehicle cannot move by itself); driving a car pushing another vehicle or object; driving a car towing a trailer or semi-trailer towing another trailer or vehicle or object; not securely and safely connecting the towing vehicle and the towed vehicle when towing each other;

i) Carrying people on the towed vehicle, except the driver;

k) Not wearing a seat belt while driving on the road;

l) Carrying people in a car without wearing a seat belt (where seat belts are equipped) while the car is moving;

m) Carrying children under 10 years old and under 1.35 meters tall in a car sitting in the same row as the driver (except for cars with only one row of seats) or not using appropriate safety equipment for children as prescribed;

n) Driving in a road tunnel without using low beam lights;

o) Driving a vehicle below the minimum speed on a road section with a prescribed minimum speed;

p) Driving at a lower speed than other vehicles traveling in the same direction without moving to the right lane of the vehicle, except in cases where other vehicles traveling in the same direction are traveling at a speed exceeding the prescribed speed.

4. A fine of VND 2,000,000 to VND 3,000,000 shall be imposed on a driver who commits one of the following violations:

a) Driving a vehicle that does not meet the conditions for collecting electronic tolls without stopping (vehicles without terminal tags) into the lane reserved for collecting electronic tolls without stopping at toll stations;

b) Stopping or parking a vehicle at the following locations: on the left side of a one-way road or on the left side (in the direction of traffic) of a two-way road; on a curved road or near the top of a slope where visibility is obstructed; on a bridge (except in cases where traffic organization permits), under an overpass (except in places where stopping or parking is permitted), parallel to another vehicle that is stopping or parking, except for the violation specified in Point c, Clause 7 of this Article;

c) Failure to take safety measures as prescribed when a car breaks down at a road intersection at the same level as a railway;

d) Not giving way to vehicles requesting to overtake when it is safe to do so;

d) Reversing or turning around in a road tunnel; stopping or parking in a road tunnel in an incorrect location; not signaling with emergency lights, not placing a “Caution parked vehicles” sign (or warning lights) behind the vehicle at a safe distance when stopping or parking in a road tunnel in case of technical problems or other force majeure that force stopping or parking;

e) Reversing on a one-way street, a street with a “No Entry” sign, a no stopping area, on a pedestrian crossing, at a road intersection, at a road intersection at the same level as a railway, or where visibility is obstructed; reversing without looking to both sides or behind the vehicle or without a reversing signal, except for the violation specified in Point d, Clause 11 of this Article;

g) Driving a vehicle directly involved in a traffic accident without immediately stopping the vehicle, not preserving the scene, and not assisting the victim, except for the violations specified in Clause 8 of this Article;

h) Vehicles with priority rights install or use priority signaling devices that are not in accordance with regulations or use priority signaling devices without a license issued by a competent authority or with a license issued by a competent authority that is no longer valid according to regulations;

i) Making a U-turn at a pedestrian crossing, on a bridge, at the head of a bridge, under an overpass, at an underground crossing, at a road intersection with a railway, on a narrow road, on a steep road, on a curved road with obstructed visibility, on a one-way road, unless there is a signal from a traffic controller or a temporary sign or traffic organization in these areas that has a U-turn area;

k) Making a U-turn at a place where there is a sign prohibiting U-turns for the type of vehicle being driven; making a left turn at a place where there is a sign prohibiting left turns for the type of vehicle being driven; making a right turn at a place where there is a sign prohibiting right turns for the type of vehicle being driven;

l) Failure to keep a safe distance to avoid collision with the vehicle in front or failure to keep the distance as prescribed by the “Minimum distance between two vehicles” sign, except for violations specified in Point d, Clause 5 of this Article.

5. A fine of VND 4,000,000 to VND 6,000,000 shall be imposed on a driver who commits one of the following violations:

a) Overtaking in cases where overtaking is not allowed, overtaking on a road section with a sign prohibiting overtaking (for the type of vehicle being driven); not signaling before overtaking or signaling but not using it during the overtaking process; overtaking on the right side of another vehicle in cases where it is not allowed;

b) Driving a vehicle that does not keep to the right in the direction of travel; driving in the wrong part of the road or lane (lane in the same direction or lane in the opposite direction) except for the acts specified in Point a, Clause 4 of this Article; driving a vehicle across the fixed median strip between two lanes of traffic;

c) Avoiding oncoming vehicles in violation of regulations (except for the violation of using high beams when avoiding oncoming vehicles as prescribed in Point b, Clause 3 of this Article); not giving way to oncoming vehicles as prescribed in narrow roads, steep roads, or places with obstacles;

d) Failure to comply with regulations when entering or exiting the highway; driving in the emergency lane or on the shoulder of the highway; failure to comply with regulations on safe distance from the vehicle in front when driving on the highway;

d) Driving a vehicle at a speed exceeding the prescribed speed by 10 km/h to 20 km/h;

e) Vehicles not entitled to priority install or use signaling devices of vehicles entitled to priority;

g) Changing lanes in an unauthorized place or without signaling or changing lanes in violation of the regulation “each lane change is only allowed to be made to one adjacent lane” when driving on the highway;

h) Using hands to hold and use phones or other electronic devices while driving a vehicle on the road;

i) Entering prohibited areas or roads with signs prohibiting entry for the type of vehicle being driven, except for violations specified in Point d, Clause 9, Point dd, Clause 11 of this Article, acts prohibited from entering irrigation works and cases of priority vehicles on urgent missions as prescribed;

k) Stopping, parking, or turning the vehicle in violation of regulations, causing traffic congestion;

l) Changing direction without giving the right of way to: pedestrians, wheelchairs of disabled people crossing the road at a crosswalk; non-motorized vehicles traveling on the road section reserved for non-motorized vehicles;

m) Changing direction without giving way to: oncoming vehicles; pedestrians; and non-motorized vehicles crossing the road at a place without pedestrian crossings;

n) Not slowing down (or stopping) and giving way when driving from a non-priority road to a priority road, or from a branch road to a main road;

o) Not reducing speed and giving way to vehicles coming from the right at an intersection without a roundabout signal; not reducing speed and giving way to vehicles coming from the left at an intersection with a roundabout signal;

p) Carrying people on the vehicle’s trunk in violation of regulations; carrying people on the vehicle’s roof; letting people hang on to the vehicle’s door or outside the vehicle’s body while the vehicle is moving;

q) Opening the car door, leaving the car door open is not safe.

6. A fine of VND 6,000,000 to VND 8,000,000 shall be imposed on a driver who commits one of the following violations:

a) Driving a vehicle at a speed exceeding the prescribed speed by more than 20 km/h to 35 km/h;

b) Not giving way or obstructing priority vehicles that are signaling priority while on duty;

c) Driving a vehicle on the road with an alcohol concentration in the blood or breath that does not exceed 50 milligrams/100 milliliters of blood or does not exceed 0.25 milligrams/1 liter of breath;

d) Driving on the sidewalk, except when driving across the sidewalk to enter a home or office.

7. A fine of VND 12,000,000 to VND 14,000,000 shall be imposed on a driver who commits one of the following violations:

a) Driving a vehicle at a speed exceeding the prescribed speed by more than 35 km/h;

b) Driving a four-wheeled motor vehicle or a four-wheeled motor vehicle on a highway;

c) Stopping or parking on the highway in an incorrect location; not signaling with emergency lights when encountering a technical problem or other force majeure that forces the vehicle to stop or park in the emergency lane on the highway; not signaling with emergency lights, not placing a warning sign “Attention to parked vehicles” (or warning lights) at least 150 meters behind the vehicle when stopping or parking in the event of a technical problem or other force majeure that forces the vehicle to stop or park in part of the lane on the highway.

8. A fine of VND 16,000,000 to VND 18,000,000 shall be imposed on a driver who commits a traffic accident and fails to immediately stop the vehicle, fails to preserve the scene, fails to assist the victim, fails to stay at the scene or fails to immediately report to the nearest police agency or People’s Committee.

9. A fine of VND 18,000,000 to VND 20,000,000 shall be imposed on a vehicle driver who commits one of the following violations:

a) Driving a vehicle on the road with a blood or breath alcohol concentration exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath;

b) Failure to comply with traffic light signals;

c) Failure to comply with the orders or instructions of traffic controllers or traffic inspectors;

d) Driving in the wrong direction on a one-way street or on a street with a “No Entry” sign, except for violations specified in Point d, Clause 11 of this Article and cases where priority vehicles are on urgent missions as prescribed.

10. A fine of VND 20,000,000 to VND 22,000,000 shall be imposed on a driver who commits one of the following violations:

a) Driving a vehicle without observing, slowing down or stopping to ensure safety as prescribed, causing a traffic accident; driving a vehicle at a speed exceeding the prescribed speed, causing a traffic accident; stopping, parking, turning, reversing, avoiding, overtaking, changing direction or changing lanes in violation of regulations, causing a traffic accident; not driving in the correct part of the road or lane, not keeping a safe distance between two vehicles as prescribed, causing a traffic accident, or entering a road with a sign prohibiting entry for the type of vehicle being driven, causing a traffic accident, except for the violations specified in Point d, Clause 11 of this Article;

b) Violating the provisions in one of the following points and clauses of this Article and causing a traffic accident: Point a, Point b, Point c, Point d, Point dd Clause 1; Point c Clause 2; Point b, Point g, Point h, Point n, Point o, Point p Clause 3; Point a, Point c, Point d Clause 4; Point c, Point d, Point e, Point h, Point n, Point o, Point q Clause 5; Point b Clause 7; Point b, Point c, Point d Clause 9 of this Article.

11. A fine of 30,000,000 VND to 40,000,000 VND shall be imposed on a vehicle driver who commits one of the following violations:

a) Driving a vehicle on the road with a blood or breath alcohol concentration exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath;

b) Failure to comply with the request for alcohol concentration testing by an officer on duty;

c) Driving a vehicle on the road while having drugs or other stimulants in the body that are prohibited by law;

d) Failure to comply with the request of a person on official duty to test for drugs or other stimulants prohibited by law;

d) Driving in the wrong direction on the highway, reversing on the highway, making a U-turn on the highway, except for priority vehicles on emergency missions as prescribed.

12. A fine of 40,000,000 VND to 50,000,000 VND shall be imposed on drivers who zigzag or swerve on the road; speed or chase each other on the road; or use their feet to control the steering wheel while the vehicle is running on the road.

13. A fine of VND 50,000,000 to VND 70,000,000 shall be imposed on a vehicle driver who commits a violation specified in Clause 12 of this Article and causes a traffic accident.

14. Vehicle confiscation for drivers who repeat the act of driving in a zigzag manner as prescribed in Clause 12 of this Article.

15. In addition to being fined, the driver who commits the violation shall also be subject to the following additional penalties:

a) Committing the act specified in Point e, Clause 5 of this Article shall also result in confiscation of priority signal transmitting equipment installed or used in violation of regulations;

b) Committing the act specified in Clause 12 of this Article shall result in the revocation of the right to use a driving license from 10 to 12 months;

c) Committing the acts specified in Point a, Point b, Point c, Point d, Clause 11; Clause 13; Clause 14 of this Article shall result in the revocation of the right to use a driving license from 22 to 24 months.

16. In addition to being subject to penalties, drivers who commit violations will also have their driving license points deducted as follows:

a) Committing the acts specified in Point h, Point i, Clause 3; Point a, Point b, Point c, Point d, Point dd, Point g, Clause 4; Point a, Point b, Point c, Point d, Point dd, Point e, Point g, Point i, Point k, Point n, Point o, Clause 5 of this Article shall result in a deduction of 02 points from the driving license;

b) Committing the acts specified in Point h, Clause 5; Clause 6; Point b, Clause 7; Point b, Point c, Point d, Clause 9 of this Article shall result in a deduction of 04 points from the driving license;

c) Committing the acts specified in Point p, Clause 5; Point a, Point c, Clause 7; Clause 8 of this Article shall result in a deduction of 06 points from the driving license;

d) Committing the acts specified in Point a, Clause 9, Clause 10, Point d, Clause 11 of this Article shall result in a deduction of 10 points from the driving license.

Article 7. Penalties and deduction of driving license points for drivers of motorbikes, mopeds, and vehicles similar to motorbikes and vehicles similar to mopeds who violate road traffic rules

1. A fine of 200,000 VND to 400,000 VND shall be imposed on a driver who commits one of the following violations:

a) Failure to comply with the commands and instructions of traffic signs and road markings, except for the violations specified in Points b, d, and e, Clause 2; Points a, c, d, and h, Clause 3; Points a, b, c, and d, Clause 4; Points b and d, Clause 6; Points a, b, and c, Clause 7; Point a, Clause 8; Point b, Clause 9; Point a, Clause 10 of this Article;

b) No signal before overtaking or signal is given but not used during the overtaking process;

c) Reversing a three-wheeled motorbike without looking to both sides and behind the vehicle or without giving a reverse signal;

d) Carrying people in the vehicle using umbrellas;

d) Failure to comply with regulations on giving way at intersections, except for violations specified in Point c and Point d, Clause 6 of this Article;

e) Changing lanes in an unauthorized place or without signaling or changing lanes in violation of the regulations “each lane change is only allowed to be made to one adjacent lane”;

g) Do not use lighting from 6:00 p.m. the previous day to 6:00 a.m. the following day or when there is fog, smoke, dust, rain, or bad weather that limits visibility;

h) Avoiding vehicles in violation of regulations; using high beams when encountering pedestrians crossing the road or when driving on a road through a residential area with an active lighting system or when encountering oncoming vehicles (except in cases where the median strip has anti-glare capability) or when changing direction at an intersection; not giving way to oncoming vehicles as prescribed in narrow roads, steep roads, or places with obstacles;

i) Using the horn from 10:00 p.m. the previous day to 5:00 a.m. the following day in densely populated areas or medical examination and treatment facilities, except for priority vehicles on duty as prescribed;

k) Driving a vehicle at a speed below the minimum speed on a road section with a prescribed minimum speed.

2. A fine of VND 400,000 to VND 600,000 shall be imposed on a driver who commits one of the following violations:

a) Stopping or parking on the roadway on a road outside urban areas where there is a sidewalk;

b) Driving a vehicle at a speed exceeding the prescribed speed from 05 km/h to under 10 km/h;

c) Driving at low speed without keeping to the right side of the road, causing traffic obstruction;

d) Stopping or parking vehicles on the roadway, causing traffic obstruction; gathering 3 or more vehicles on the roadway or in a road tunnel; illegally parking or leaving vehicles on the roadway or sidewalk;

d) Vehicles that are not entitled to priority must install or use the signaling device of vehicles with priority;

e) Stopping or parking at pick-up or drop-off points, at road intersections, on pedestrian crossings; stopping where there is a “No stopping and parking” sign; parking where there is a “No parking” or “No stopping and parking” sign; failing to comply with regulations on stopping or parking at road intersections at the same level as railways; stopping or parking within the railway traffic safety corridor;

g) Carrying 02 people in the vehicle, except in cases of transporting sick people for emergency care, children under 12 years old, elderly or disabled people, or escorting people who have violated the law;

h) Not wearing a “helmet for motorcyclists” or wearing a “helmet for motorcyclists” without properly fastening the strap when driving a vehicle on the road;

i) Carrying a person on a vehicle who is not wearing a “helmet for motorcyclists” or wearing a “helmet for motorcyclists” that is not properly fastened, except in cases of transporting a sick person to the emergency room, a child under 6 years old, or escorting a person who has violated the law;

k) Making a U-turn in a place where U-turns are not allowed, except for the violation specified in Point d, Clause 4 of this Article.

3. A fine of 600,000 VND to 800,000 VND shall be imposed on a driver who commits one of the following violations:

a) Changing direction without observing or ensuring a safe distance from the vehicle behind or without reducing speed or without using a turn signal or using a turn signal but not using it continuously during the change of direction (except when driving along a curve of a road section where the road does not intersect at the same level); turning left at a place with a sign prohibiting left turns for the type of vehicle being driven; turning right at a place with a sign prohibiting right turns for the type of vehicle being driven;

b) Carrying 03 or more people in the vehicle;

c) Stopping or parking on the bridge;

d) Driving a vehicle that does not keep to the right in the direction of travel; driving in the wrong part of the road or lane (lane in the same direction or lane in the opposite direction); driving a vehicle across the fixed median strip between two lanes of traffic;

d) Overtaking on the right where not permitted;

e) A person driving a vehicle or carrying a passenger on the vehicle, holding on to, pulling, pushing another vehicle or object, leading an animal, carrying bulky objects; carrying a person standing on the saddle, on the carrier or sitting on the handlebars of the vehicle;

g) Driving a vehicle towing another vehicle or object;

h) Driving in a road tunnel without using low beam lights;

i) Not keeping a safe distance to avoid a collision with the vehicle in front or not keeping the distance as prescribed by the sign “Minimum distance between two vehicles”;

k) Driving a vehicle in a row of 3 or more vehicles;

l) Vehicles with priority rights install or use priority signaling devices that are not in accordance with regulations or use priority signaling devices without a license issued by a competent authority or with a license issued by a competent authority that is no longer valid according to regulations.

4. A fine of VND 800,000 to VND 1,000,000 shall be imposed on a driver who commits one of the following violations:

a) Driving a vehicle at a speed exceeding the prescribed speed by 10 km/h to 20 km/h;

b) Stopping or parking in a road tunnel in an incorrect location;

c) Overtaking in cases where overtaking is not allowed, overtaking on a road section with a sign prohibiting overtaking for the type of vehicle being driven, except for violations specified in Point d, Clause 3 of this Article;

d) Turning the vehicle around in a road tunnel;

d) The person driving the vehicle uses an umbrella, audio equipment (except hearing aids), handles and uses the phone or other electronic devices.

5. A fine of VND 1,000,000 to VND 2,000,000 shall be imposed on a driver who commits one of the following violations:

a) Driving a vehicle directly involved in a traffic accident without immediately stopping the vehicle, not preserving the scene, not assisting the victim, except for the violation specified in Point c, Clause 9 of this Article;

b) Changing direction without giving the right of way to: pedestrians, wheelchairs of the disabled crossing the road at a crosswalk; non-motorized vehicles traveling on the road section reserved for non-motorized vehicles;

c) Changing direction without giving way to: oncoming vehicles; pedestrians, and non-motorized vehicles crossing the road at places where there are no pedestrian crossings.

6. A fine of VND 2,000,000 to VND 3,000,000 shall be imposed on a driver who commits one of the following violations:

a) Driving a vehicle on the road with alcohol concentration in blood or breath not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/1 liter of breath;

b) Entering a prohibited area or a road with a sign prohibiting entry for the type of vehicle being driven, except for violations specified in Point a and Point b, Clause 7 of this Article and cases where priority vehicles are on urgent missions as prescribed;

c) Not slowing down (or stopping) and giving way when driving from a non-priority road to a priority road, or from a branch road to a main road;

d) Not reducing speed and giving way to vehicles coming from the right at an intersection without a roundabout signal; not reducing speed and giving way to vehicles coming from the left at an intersection with a roundabout signal.

7. A fine of VND 4,000,000 to VND 6,000,000 shall be imposed on a driver who commits one of the following violations:

a) Driving in the wrong direction on a one-way street, driving in the wrong direction on a street with a “No entry” sign, except for violations specified in Point b of this Clause and cases of priority vehicles on emergency missions as prescribed; driving on the sidewalk, except for cases of driving across the sidewalk to enter a house or office;

b) Driving a vehicle onto the highway, except for vehicles serving highway management and maintenance;

c) Failure to comply with traffic light signals;

d) Failure to comply with the orders or instructions of traffic controllers or traffic inspectors;

d) Not giving way or obstructing priority vehicles that are signaling priority while on duty.

8. A fine of VND 6,000,000 to VND 8,000,000 shall be imposed on a driver who commits one of the following violations:

a) Driving a vehicle at a speed exceeding the prescribed speed by more than 20 km/h;

b) Driving a vehicle on the road with a blood or breath alcohol concentration exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath.

9. A fine of VND 8,000,000 to VND 10,000,000 shall be imposed on a driver who commits one of the following violations:

a) Driving a vehicle in a zigzag or swerving manner on the road; using the kickstand or other objects to scrape the road while the vehicle is running;

b) Driving in a group of 02 or more vehicles at a speed exceeding the prescribed speed;

c) Causing a traffic accident without immediately stopping the vehicle, not preserving the scene, not assisting the victim, not staying at the scene or not immediately reporting to the nearest police agency or People’s Committee;

d) Driving a vehicle on the road with a blood or breath alcohol concentration exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath;

d) Failure to comply with the request for alcohol concentration testing by an officer on duty;

e) Driving a vehicle on the road while having drugs or other stimulants in the body that are prohibited by law;

g) Failure to comply with the request of a person on official duty to test for drugs or other stimulants prohibited by law;

h) Sit in the back and put your arms around the person in front to control the vehicle, except when carrying a child under 6 years old sitting in the front;

i) Driving in groups causing traffic obstruction, except in cases where permission is granted by a competent authority;

k) Using horns and revving engines continuously in densely populated areas or medical examination and treatment facilities, except for priority vehicles on duty as prescribed.

10. A fine of VND 10,000,000 to VND 14,000,000 shall be imposed on a driver who commits one of the following violations:

a) Driving a vehicle without observing, slowing down or stopping to ensure safety as prescribed, causing a traffic accident; driving a vehicle at a speed exceeding the prescribed speed, causing a traffic accident; entering a highway, stopping, parking, turning, reversing, overtaking, changing direction or changing lanes in violation of regulations, causing a traffic accident; not driving in the correct part of the road or lane, not keeping a safe distance between two vehicles as prescribed, causing a traffic accident, or entering a road with a sign prohibiting entry for the type of vehicle being driven, driving in the opposite direction of a one-way road, or driving in the opposite direction on a road with a sign “No entry” causing a traffic accident;

b) Violating the provisions in one of the following points and clauses of this Article and causing a traffic accident: Point a, Point d, Point dd, Point g, Point h, Point i, Point k Clause 1; Point c, Point dd, Point g Clause 2; Point b, Point e, Point g, Point h, Point k Clause 3; Point dd Clause 4; Point c, Point d Clause 6; Point c, Point d, Point dd Clause 7; Point a, Point b, Point h, Point k Clause 9 of this Article.

11. Vehicle confiscation for drivers who commit one of the following violations:

a) Let go of both hands while driving; use feet to control the vehicle; sit on one side to control the vehicle; lie on the saddle to control the vehicle; change drivers while the vehicle is running; turn around to control the vehicle or blindfold the vehicle;

b) Driving a two-wheeled vehicle on one wheel, or a three-wheeled vehicle on two wheels;

c) Repeatedly committing the act of driving in a zigzag or swerving manner as prescribed in Point a, Clause 9 of this Article.

12. In addition to the main penalty, the driver committing the violation shall also be subject to the following additional penalties:

a) Committing the act specified in Point d, Clause 2 of this Article shall also result in confiscation of priority signal transmitters installed or used in violation of regulations;

b) Committing the acts specified in Point a, Point b, Point h, Point i, Point k, Clause 9 of this Article shall result in the suspension of the right to use a driving license from 10 months to 12 months;

c) Committing the acts specified in Point d, Point dd, Point e, Point g, Clause 9; Clause 11 of this Article shall result in the revocation of the right to use a driving license from 22 to 24 months.

13. In addition to being subject to penalties, drivers who commit violations will also have their driving license points deducted as follows:

a) Committing the acts specified in Point b, Clause 3; Clause 5; Point b, Point c, Point d, Clause 6; Point a, Clause 7 of this Article shall result in a deduction of 02 points from the driving license;

b) Committing the acts specified in Point d Clause 4; Point a Clause 6; Point c, Point d, Point dd Clause 7; Point a Clause 8 of this Article shall result in a deduction of 04 points from the driving license;

c) Committing the acts specified in Point b, Clause 7, Point c, Clause 9 of this Article shall result in a deduction of 06 points from the driving license;

d) Committing the acts specified in Point b, Clause 8, Clause 10 of this Article shall result in a deduction of 10 points from the driving license.
